As soon as I gathered from her disjointed announcement that my husband had been killed in a horrific rail accident, I felt myself collapsing into an infinite depression of emptiness, silence and sorrow. My heart and soul were thrust downwards as if a cumbersome mass was depressing my frame, as the eruption of grief forced me to express a plethora of tears into the sympathetic arms of my dear Josephine. Despite the initial and genuine reaction to my sudden loss, I almost felt it my duty to weep for my deceased husband. Of course I loved him, as a companion; he was a means of fortification against the world and a way out of eternal spinsterhood and loneliness, and his mind and soul had now departed forever. Five minutes or so had passed, and I carried myself to my room with little motivation, where I sat in silence, reflecting on the news whilst giving my anaesthetised body an opportunity to recover from the horrific shock which was delivered earlier on. After a period of reflection, I realised that a new beginning seemed to be commencing for me. As I glanced out of the window, I caught a glimpse of the delightful pastel-coloured blossom beginning to appear in the trees. The wildlife animated the street below and a lively new air swept across the room, carried by the sweet spring breeze. I was perplexed, since this charming feeling had approached and briefly refreshed my mood; yet my energy had completely evaporated and my torn, slashed spirit progressed further and further away as if it had no intention of returning to me. The emptiness remained in the atmosphere like an unwelcome storm cloud spoiling an otherwise perfect blue sky. I pressed my head to the material behind me and pondered further. I was aware that I would soon need to confront my fears of seeing my husband before a burial, and the terrible emotions which viciously attacked me would return stronger. However, I also thought of the freedom; I have always wanted to escape. The claustrophobia had almost been too much to battle on occasions. Of course, I would not ever have had the means to escape and it is never considered proper for a lady to leave a respectable, healthy husband. Besides, he would not have let me go, I am quite certain. I was going to be ensnared forever. But after this, I could live without requesting permission. My mind became entranced and the idea of finally being free from eternal slavery dominated my thoughts. Josephine soon arrived at my door, calling for me to open it. Of course, I could not let her in, as I needed to clear the misty fog surrounding my head and collect together my thoughts, which were strewn everywhere. She insisted that I would become ill. However, I assured her that I would not, and immediately I descended back into deep contemplation. My entire surroundings rotated and merged together in my mind, as I managed to absorb a new soul and a positive belief of a more blissful future of freedom. I left the room after my courage was gained enough to for my legs to stand my weight and clasped to Josephine’s wrist. She led me down the staircase to where Richard was stood, and there appeared to be someone entering the house. My curiosity compelled me to glance over at the gentleman, but as I did, I recognised his face. I then realised that this gentleman was my husband. Everlasting amounts of air flooded into my lungs, as my expanding heart was speared by the savage storm of shock and dismay.

PROTECTION AGAINST INTELLECTUAL PROPERTY RIGHTS INFRINGEMENT The infringement of intellectual property rights (IPRs) are by administrative procedures and legal proceedings. In civil liabilities, the infringer may ordered to stop the violated activities, eradicate the damage done, make public apologies and compensate for all the damages. In administrative measures and criminal liabilities, they include warnings in order to stop the violating activities, fines, and compensation for damages made. The interested parties go for mediation, when there is IPR infringement dispute arises. If mediation failed, or interested parties refused to abide by the outcome of mediation, legal proceedings may be instituted with peoples court. The interested parties may also request the relevant administrative authorities for actions. LEGAL PROCEEDINGS When an IPR infringement dispute arises, the infringed party may institute legal proceedings directly with the peoples court at the place where infringing activity takes place.. If an interested party finds that due to emergency or by any delay in stop the infringing activities may cause damages to his/her rights, he may, before instituting legal proceedings, request the peoples court to freeze the assets of the infringer. The peoples court will see to it that the infringer, if the infringer is convicted, he will be made to bear civil liabilities for the infringing act. The infringer will be prosecuted for his criminal liabilities where the case is so serious to constitute a crime. ADMINISTRATIVE PROCEDURES Information and Proof to be Submitted When infringement of IPR dispute rises, the interested may request the administrative authorities and above at the place of the infringers domicile In order to make the request to the administration authorities, the interested party should have to submit a written proof of his right and evidence of the infringing act. Processing by Administrative Authorities It is the duty of the administrative authorities to handle the dispute and they have to make decision whether the complaint will be processed with in 15 days upon receipt of the request and they have to tell their decision to the applicant.If the decision is negative, a written explanation will be given to the applicant and if the decision given by the administration authorities is negative than the applicant will given a explanation in written form within 7 days. Calculation of Compensation On the request of the applicant, the competent administrative may order the infringer to pay for damages. For infringing of copyright, the compensation amount is calculated according to the direct damages caused by the infringement and reasonable fees incurred by the copyright holder in investigating and stopping the infringing act. For infringing of trademark, the compensation amount is calculated on the basis of profits gained by the infringer through the infringement during the infringement period or the damages suffered by the infringed party during the infringement period. For infringing of patent, the amount of compensation is calculated according to the damages suffered by the patentee or the profit which is gained by the infringer through the infringement. Where it is difficult to determine the damages suffered by the patentee. It is also difficult to calculate that how much profit is earned by the infringer, royalty amount of patent may used as per calculation. Dissatisfaction with Administrative Punishment Decisions Instituting administrative proceedings If the interested party is not satisfied with the punishment made by the administrative authorities than within 3 months from the receipt of the notification of decision, and apply to the local government or administrative securities at higher level for reconsideration of the decision. Instituting administrative reconsideration Within 10 days, the authorities should have to decide whether to handle the case or not. If the interested party is satisfied than within 2 months for reconsideration, a decision should be made on that basis. If the interested party is not satisfied with the decision on reconsideration than within the 15 days after the receivable of the notification of the decision, institute administrative proceedings with the peoples court. EFECTIVENESS OF LEGAL ACTION AGAINST INFRINGEMENT PIRACY It is practically very difficult to completely prevent piracy / infringement / violation of intellectual property rights as we know India is a very large country in geographical terms and densely populated country. There are own advantages and limitations of civil and criminal legal actions. Mostly piracy in India takes place in small scale industries, unorganized sector A separate suit has to be filed against each and every company / firm / individual in civil suits, which are filed against infringements, as the infringement by each pirate will amount a new cause of action, separate suits have to be filed against each of them. As compare to criminal remedies the civil remedies are easier. Due to publicity, campaigning the effectiveness of criminal remedies is more as compared to civil remedies. Any criminal action / prosecution is treated as a social stigma in India which leads to condemnation by the society. PROVISIONAL MEASURES The judicial authorities shall have the authority to order promptly and effectively provisional measures: (a) to prevent an infringement of intellectual property rights from occurring, and in order to prevent the entry into the channels of commerce in their jurisdiction of goods, including imported goods immediately after customs clearance (b) to preserve supportive evidence in regard to the IPR infringement. The judicial authorities shall have the authority to require the applicant to provide any reasonably available evidence in order to satisfy themselves with a sufficient degree of certainty that the applicant is the right holder and that the applicants right is being infringed or that such infringement is imminent, and to order the applicant to provide a security or equivalent assurance sufficient to protect the defendant and to prevent abuse. Where provisional measures have been adopted inaudita altera parte, the parties affected shall be given notice, without delay after the execution of the measures at the latest. A review, including a right to be heard, shall take place upon request of the defendant with a view to deciding, within a reasonable period after the notification of the measures, whether these measures shall be modified, revoked or confirmed. The applicant may be required to supply other information necessary for the identification of the goods concerned by the authority that will execute the provisional measures. Without prejudice to paragraph 4, provisional measures taken on the basis of paragraphs 1 and 2 shall, upon request by the defendant, be revoked or otherwise cease to have effect, if proceedings leading to a decision on the merits of the case are not initiated within a reasonable period, to be determined by the judicial authority ordering the measures where a Members law so permits or, in the absence of such a determination, not to exceed 20 working days or 31 calendar days, whichever is the longer. Where the provisional measures are revoked or where they lapse due to any act or omission by the applicant, or where it is subsequently found that there has been no infringement or threat of infringement of an intellectual property right, the judicial authorities shall have the authority to order the applicant, upon request of the defendant, to provide the defendant appropriate compensation for any injury caused by these measures. To the extent that any provisional measure can be ordered as a result of administrative procedures, such procedures shall conform to principles equivalent in substance to those set forth in this Section.

Use of Symbolism in Steinbeck's Flight In his classic short story, "Flight," John Steinbeck uses many examples of symbolism to foreshadow the conclusion. Symbolism can be anything, a person, place or thing, used to portray something beyond itself. It is used to represent or foreshadow the ending of the story. Steinbeck uses colors, direction, and nature symbolism to help presage Pepà ©'s tragic death. Let us now more closely examine the ways that Steinbeck uses colors to foreshadow the ending of his short story. Perhaps the most repeatedly used symbol in "Flight," is the color black. In literature many authors use black to represent death. There are numerous examples in this short story. Some of these include the black handle on the long blade, Pepà ©'s black hair and the black jerky. Another example may be found when Pepà © puts on his fathers black coat, which represents death. When Pepà © puts on the coat he is literally covering himself with death. Another fine example is the trail in which Pepà © travels. Steinbeck describes the path as a well-worn black path. By traveling on this path he is in fact taking the road of death. Furthermore Pepà ©'s appearance also helps foreshadow the ending. Steinbeck describes him as having a black hat that covers his black thatched hair. Pepà © is also described as being dark, lean and tall. Another example is Pepà ©'s shack. The shack is described as weathered and very old. It casts a rather large shadow to the North east. The darkness of the shadow symbolizes death in the home. As we can readily see, the authors use of black symbolism in the story tells us that the main character, Pepà ©, is impending death. Another commonly used symbol in the story "Flight," is direction. Direction is used to represent positive or negative effects. North and East are generally "good" directions. Many people feel this came about when the early man saw the sun rise in the East. On the contrary, the directions South and West are generally "bad" directions. Basically this is because the sun sets in the West. Besides compass directions, height is also a very popular way of foreshadowing the conclusion of the story. The direction up, which is also the way to heaven is generally "good," while down, the direction of hell, is considered to be "bad." An example of this form of symbolism can be found when Pepà © is returning home.

It is important here to define ‘poverty’ for clear understanding and demarking the poverty line. Widely accepted definition poverty states that â€Å"an enforced lack of socially perceived necessities†(ACOSS) which means that people are disabled or have deficient money flow to buy enough food, pay rent and stay in a good accommodation, good clothes, lack of clean water and electricity for non-payment of government charged bills which otherwise drive people to compromise and adjust with whatever comes in a way either by choice or by chance and compels to stay satisfied. Alleviation of poverty is a long-term process and mostly it is recurring in several states. In order to completely eliminate poverty, strong laws of social welfare and status of living standards must be construed in order to ensure economic growing of living as a whole in all nations particularly in Australia as this paper discusses. A thorough study and survey, research must be made in order to conclude and identify the ground reasons of poverty. There is a huge gap between rich and wealthy people and poor people, which means that wealthy people continue to expand riches whereas poor and needy people continue to live in deteriorated poverty which is unacceptable and should not be encouraged keeping the future generations of children. A study of UNICEF confirms that Australia has 56. 2 per cent of children who are living with solo mothers which provides a fact that, how difficult it is for single mothers to make a status for living and in settling children. This is further confirmed by Australian Democrats, â€Å"Overall, the results demonstrate that unemployment continues to be a major cause of poverty in Australia and that employment only provides an escape when it comes in the form of a full-time job. But could he manage to get this across successfully? The opening sequence sets the mood for the film as it gives you a good idea of the dramatic, devastating scenes you are about to see. The film begins in colour; this shows that there is still life and hope for the Jews. The Hebrew prayer shows the worry that the Jews are going through, but they are all grouping together holding hands during the prayer. It also shows the emotion and seriousness of the holocaust. The burning candle is a symbol of the Jews life gradually disappearing into nothing, the gradual disintegration of the Jewish community; it also shows the hope of the Jews fading to nothing. The effect of the film beginning in colour then changing into black and white was to be a symbol of the Jews life; the colour shows the Jews hope fading to black and white to show the mass killing. It also brings home how grim and dismal life was in the 1940s. It then returns to colour to show that the horror is over and that they can try and get on with their damaged life after 4,086,000 Jews were killed. During the end of the film Spielberg uses people that went through the trauma of the holocaust in the 1940s, this adds more feeling to the film. The film is chaotic, people are running frantically as the Germans carelessly shoot at them for being Jewish, a little girl in a red coat manages to escape, coming as a surprise halfway through the film. The colour brings your attention to the little girl, it also represents the blood lost during the holocaust. You later see the girl amongst a pile of dead bodies ready to be burnt. This shows that each individual had a life and even children who were innocent were killed. The music that was played throughout the film plays a big part in getting across the emotion and feelings during the holocaust. At the beginning the Germans are at an officers club. They play tango dance music, showing the frivolous lifestyle that the Germans lead, dancing, smoking, drinking etc. At the snow shoveling scene where the Jews are working, there are violins playing, implying great emotion, sadness and suffering. From the beginning the difference between the Jews was highlighted by the Nazis arm bands, and badges. The symbol is the Star of David and the Nazis have a Swastika. The Jews identity was taken away from them, womens hair was shaved off, this made them feel inferior and humiliated. Men and women were treated very differently in the camps. The men were given harder, manual labour in the camps, but the women were most likely to be sent to the gas chambers. To try and avoid this terrible death they would prick their fingers and put the blood on their cheeks to try and make themselves look more attractive so that they would be given work. The Nazis also treated their own women in a demeaning manner, treating them more like objects than people. During the film there is quite a lot of dramatic irony three examples are: Oskar Schindler discussing the aftermath of the war, planning to make lots of money by working the Jews. He says that the Germans will leave with trunk loads of money. We know that the Germans lose the war and many were executed for war crimes. Before the Jews are separated into ghettos a woman says Things cant possibly get any worse. We know that things do get much worse before they enter the camp. Children are told they are going to be taken on a day trip. They leave happy, singing and smiling. Not knowing that they will be gassed. You are a Jew and I am a German Oskar Schindler says this to Stern. This means that Schindler doesnt care what race/religion Stern belongs to. He just wants his help keeping the Jews alive and working. One more, just one more This is said by Oskar at the end of the war. He feels upset and angry that he could have saved more Jews, if he had given them all his money. There were many dramatic moments throughout the film, two of these being: The Jews belongings were being taken from their bodies after they were killed, such as gold fillings and jewellery; this showed not only the amount of Jews being killed but the German greed and lack of emotion for the amount of murdered Jews. The Jews were that desperate to stop the Germans getting their jewellery that they ate their rings and necklaces. The Germans were also jealous that the Jews were fairly wealthy. Children were also gassed in the camps, they were young and innocent. The children were none the wiser and were told that they were going on a trip. They were happy but misled. This shows the reality that not only adults were killed but children as well, and that familys were destroyed and separated.
